The high stakes of DUI offenses for truck drivers

On Behalf of | Jan 3, 2025 | Criminal Defense

Driving under the influence (DUI) is a serious offense, particularly for truck drivers whose livelihoods depend on maintaining a clean driving record. The law also places greater restrictions on truck drivers. What should truck drivers know about these unique challenges?

Truck drivers will lose their CDL after a drunk driving conviction.

One of the most immediate and devastating impacts of a DUI charge for a truck driver is that they could lose their Commercial Driver’s License (CDL). Even a first offense will result in a one-year disqualification. This not only means a temporary halt in their ability to work but can also have long-term career implications.

A second drunk driving charge has an even more severe impact because it will lead to a lifetime disqualification. As a result, a second conviction could end their career.

Truck drivers can face drunk driving charges at lower BAC levels.

In most situations, adult drivers cannot legally drive if their blood alcohol concentration (BAC) is 0.08% or higher. However, the rules are stricter for those operating commercial vehicles due to the potential for greater harm in the event of an accident.

In Maryland, drivers cannot operate a commercial vehicle with a BAC of 0.04% or more, half of the limit for regular passenger vehicle drivers. This means that truck drivers could face charges and the loss of their CDL with much less alcohol in their system if they are behind the wheel of their truck.

Truck drivers must navigate more stringent regulations regarding DUI offenses. These charges can not only impact their lives but also seriously impact – or end – their careers. As a result, it is crucial for truck drivers to understand the gravity of DUI laws and their legal options if they face drunk driving charges.
